The case of the petitioners is that they are the lessees of fourth respondent temple and their lease was expired in the year 2011 and after that they have been paying lease amounts regularly and that the petitioners have issued notices on 17.04.2015 asking them to vacate the premises within seven

days, otherwise legal action will be taken. But, now without following due procedure, respondent-temple is trying to evict the petitioners. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioners and the learned Government Pleader for Endowments appearing for respondents 1 to 3 and Sri Ch.Satish Kumar, learned counsel for respondent No.4. Both the counsel agreed for disposal of the writ petition at the stage of admission. Learned counsel for the petitioners submits that even after expiry of lease, petitioners are paying rents regularly but without following Section 83 of the Endowments Act (for short 'the Act') notices were issued by the respondent to vacate the premises.

On the other hand, learned GP for Endowments submits that notices for handing over the possession were issued and that they would not evict the petitioners without following due procedure as envisaged under Section 83 of the Act. Learned counsel Sri Ch.Satish Kumar, appearing for 4th respondent also reiterates the contentions of the Government Pleader. In view of the same, the petitioners shall not be evicted without following due procedure as envisaged under law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________ A. RAJASHEKER REDDY, J Rns HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY
