THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12567 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused Officer in Crime No.15/RCT-CR-2/2023, dated 25.11.2023 on the file of PS., Anti-Corruption Bureau, City Range-2, Hyderabad, registered for the offence punishable under Section 7(a) of the Prevention of Corruption Act, 1988 (as amended in the year 2018).

Heard learned counsel for the petitioner and learned Special Public Prosecutor for the respondent-State and perused the record.

The respondent-ACB arrested this petitioner on 25.11.2023 having trapped him for accepting bribe of Rs.10,000/- from the de facto complainant.

The de facto complainant filed a complaint on 23.11.2023 and after preliminary investigation, the trap was laid on 25.11.2023. In the complaint it is alleged that this

petitioner had demanded an amount of Rs.10,000/- for processing the application filed by the de facto complainant for effecting the change of name of mother of de facto complainant.

Learned counsel for the petitioner would submit that major part of the investigation is complete. As can be seen from the Remand Report and through Mediators Report, all the relevant documents have been seized. The petitioner is in jail since 26.11.2023.

On the other hand, learned Special Public Prosecutor for ACB opposed the bail application on the ground that the investigation is still pending.

As seen from the record, the relevant application and other documents were seized at the time of mediators report. Since the petitioner is in jail and major part of the investigation appears to be complete, the prayer for regular bail is considered, subject to the following conditions: i) The petitioner/accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to the

satisfaction of the Prl. Special Judge for SPE & ACB Cases at Hyderabad.

ii) The petitioner/accused after release shall appear before the concerned Station House Officer on every Monday and Wednesday for a period of four (04) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioner/accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 8.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
