OFFICE NOTE 24.4.2023 Dr.CSL, J I.A.No.2 of 2023 This interlocutory application is filed seeking the Court for relaxation of the condition of appearance of the petitioners before the Police concerned.
Heard Sri Md. Shaha Buddin, learned counsel for the petitioners as well as learned Additional Public Prosecutor who is representing the respondent-State. Though Sri R.Mangulal, learned counsel, is on record representing the defacto complainant, none appears.
Learned counsel for the petitioners submits that while enlarging the petitioners on bail, vide orders in Criminal Petition No.10297 of 2022, dated 28.11.2022, this Court ordered the petitioners-accused Nos.2 and 3 to appear before the Station House Officer, Saroornagar Police Station, on every Monday and the petitioners are complying with the said condition since five months and they are facing much difficulty in complying with the said condition and therefore, the same may be relaxed.
Learned Additional Public Prosecutor states that except twice, the petitioners appeared before Contd...,
Contd..., the Police concerned regularly and thus, necessary orders may be passed.
Having considered the submissions made thus and as the requirement of further attendance of the petitioners before the Police concerned is not shown, this Court considers it desirable to relax the condition as prayed for. Hence, the condition imposed regarding appearance of the petitioners before the Police concerned on every Monday is hereby relaxed.
