THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.24927 of 2015 ORDER :
The petitioner claims to be the absolute owner of the property in Sy.No.2380/B admeasuring 322.05 Square yards, Vidyanagar, Huzurabad, Karimnagar District. The petitioner intend to construct a residential house and applied for grant of building permission and accordingly the permission was granted on 22.03.2014. The petitioner now alleges that even though he has valid building permission and is undertaking construction in accordance with the said permission granted, the authorities of the respondent are interfering and obstructing the construction taken up by the petitioner. Aggrieved thereby, this writ petition is instituted.
2. Learned Standing counsel fairly submits that the Municipality is not interfering with the construction of the petitioner and it is a false allegation made by the petitioner.
3. Having regard to the respective submissions made, the writ petition is disposed of, directing the respondent authorities, not to interfere with the construction activity of the petitioner consequent to the building permission granted on 22.03.2014, if the said building permission is not rescinded and shall ensure that the petitioner is not deviating from the sanctioned plan. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
