HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35310 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.592 of 2016 on the file of Banjara Hills Police Station, Hyderabad. 2.

Heard and perused the material available on record. 3.

Learned Counsel for the petitioner submitted that the petitioner being a Social worker went to Film chamber, wherein a floor had collapsed due to the negligence of the concerned at the time of construction, to help the victims and their family members, and on seeing the same, the 2nd respondent bore grudge against the petitioner and registered a false case alleging that the petitioner forcibly entered into the film chamber. 4.

The petitioner filed this writ petition challenging the investigation in the above crime. Even though this Court is not inclined to interfere with the investigation in the above crime, but taking into consideration the circumstances of the case and the submissions made by the learned Counsel for the petitioner, this Court is of the view that the above crime can be investigated into, without arresting the petitioner. 5.

Accordingly, respondents Nos.1 and 2 are directed to complete the investigation and file a final report in the above Crime, in accordance with law, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
