THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9145 of 2015 ORDER:

The writ petition is filed seeking the following relief: "..... to issue an order or direction more in the nature of mandamus directing the Respondent No.2 to entertain either Appeal or Revision Petition against the order of the Director of Settlements dated 19-9-2013 to be heard along with the Revision Petition No.L1/152/2013 filed by the Respondent No.7 on the file of the Respondent No.2 and consequently to permit the petitioner herein to file detailed grounds of appeal or revision petition as is maintainable under the provisions of Regulation 2/70 within a specified period of four weeks from the date of the orders of this Hon'ble Court and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

At the hearing, the learned counsel for the petitioner fairly submits that, on going through the material he has advised the petitioner to avail the alternative remedy of Revision and seek appropriate interim orders there. The learned counsel also points out that in relation to the same proceedings, this Court disposed of W.P.No.28723 of 2013, by giving liberty to the petitioner therein to avail the alternative remedy available. In that view of the matter, the learned counsel seeks liberty to the petitioner to avail the alternative remedy of revision.

This Court, by order dated 04.10.2013, disposed of W.P.No.28723 of 2013, by giving liberty to the petitioner therein to file Revision and also directed the 6th respondent-Tahsildar not to dispossess the petitioner from the land, pending passing of appropriate interim orders from the revisional authority.

4. Considering the orders passed in W.P.No.28723 of 2013, there shall be similar orders in this writ petition as well. Accordingly, the petitioner is relegated to the remedy of revision. To facilitate the petitioner to seek appropriate interim orders, the respondents, in particular the 6th respondent-Tahsildar, and his subordinates are directed not to dispossess the petitioner from the land in question, for a period of two months from today.

5. With the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions shall stand closed. ____________________________ CHALLA KODANDA RAM, J 02nd April, 2015 KSM
