THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10017 OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Public Prosecutor.

2. The present Criminal Petition came to be filed by the petitioners/A.1 and A.2 under Section 438 Cr.P.C., seeking release in the event of their arrest in Crime No.107 of 2016 of Kukunoorpally Police Station, Medak district, registered against them and another for the offences punishable under Sections 379 and 511 of the Indian Penal Code, 1860.

3. The case of the prosecution is that when the vehicle bearing Regn. No.TS05UA 9990 was detained at the police station for the purpose of imposing penalty as it was overloaded, it was dishonestly taken away by the accused without permission from the custody of the police by breaking open the lock. Basing on these allegations the present case came to be registered.

4. Admittedly, petitioner no.1 is owner of the vehicle. Petitioner No.2 is brother of petitioner no.1. The offences alleged are triable by the Magistrate.

Therefore, the petitioners are directed to surrender themselves before the Magistrate concerned within a period of 10 days from today and move an application for bail, in which event, the same shall be considered on the same day and the petitioners shall be released on bail on such terms and conditions as the said Court deems fit and proper.
