ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for a Certiorari to quash order, dated 16.12.2015, in Original Application No.6416 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal'). The petitioner has sought multi fold reliefs before the Tribunal which include her reinstatement and also payment of subsistence allowance during the suspension period. However, the Tribunal without hearing the learned Government Pleader or any one representing him on behalf of the respondents has dismissed the said O.A. by

drawing its own assumptions.

Today, at the hearing, learned Assistant Government Pleader for Services (Andhra Pradesh) submitted that the suspension last extended was on 13.9.2014 up to 19.01.2015 and that, since then, the petitioner's suspension was neither extended nor she was formally reinstated into service. He has further submitted that subsistence allowance was paid to the petitioner up to 19.01.2015 only.

In the light of the fact that the petitioner's suspension was not extended beyond 19.01.2015, she is entitled to reinstatement forthwith.

Accordingly, respondent Nos.1 to 3 are directed to forthwith take the petitioner into duty which shall be subject to the conclusion of the disciplinary proceedings. The entitlement of the petitioner to salary, etc., till her reinstatement shall also be subject to the result of the disciplinary proceedings.

Subject to the above directions and observation, the Writ Petition is disposed of.
