HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.4946 of 2018 Order:

The application filed by the petitioner under Order XXII, Rule 4 CPC, to come on record as legal representative of the deceased 3rd respondent in L.A.O.P.No.45 of 2015 having been dismissed, he is before this Court.

2. Heard Mr. Botla Venkateswara Rao, learned counsel for the petitioner.

3. It appears that both the Land Acquisition Officer as well as the contesting respondents recorded 'No Objection' to the application of the petitioner under Order XXII, Rule 4 CPC. But the said application was dismissed on the ground that the property is not covered. If the property is not covered, the petitioner's mother could not have been permitted to withdraw the compensation. What applies to the petitioner's mother will equally apply to the petitioner. Therefore, the civil revision petition is allowed. The pending applications, if any, shall stand closed. No costs. __________________________ V.RAMASUBRAMANIAN, J.
