This Criminal Petition is filed by under Section 482 Cr.P.C. seeking to quash the order dated 18.07.2016 , passed in Crl.M.P.No.4050 of 2015 in C.C.No.656 of 2011 on the file of V-Additional Judicial Magistrate of First Class, Rajamahendravaram.

Heard and perused the material available on record. The grievance of the petitioner is that if the prosecution is permitted to secure the witnesses and allow to re-open the trial for examination of the witnesses, the petitioner would suffer.

A perusal of the record shows that the learned Magistrate has passed the impugned order in the interests of justice and I do not find any ground to interfere with the same.

Accordingly, the Criminal Petition is dismissed. Needless to say, the petitioner is at liberty to cross-examine the witnesses. Consequently, pending miscellaneous applications, if any, shall stand closed. __________________ M.S.K.JAISWAL, J 12th September 2016 mar
