THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.10588 of 2013 ORDER:

Complaining interference by 3rd respondent with the personal liberty of petitioner and calling the petitioner to police station and taking blank signed papers of petitioner, the instant writ petition is filed.

The Assistant Government Pleader (Home) basing on instructions dated 15-04-2013 submits that no crime is registered against the petitioner. Hence, there was no occasion to call the petitioner to police station for any of the purposes stated in the writ affidavit. He further submits that the petitioner is the complainant in Cr.No.96 of 2013. Unfortunately, he is not co-operating with the police. Be that as it may, the writ petition is not filed complaining inadequate investigation in Cr.No.96 of 2013.

Since the 3rd respondent submits that he did not interfere in the personal liberty of petitioner or has taken any signature from petitioner, this Court is satisfied that by placing on record the statement made by the 3rd respondent through Assistant Government Pleader, the writ petition can be disposed of.

The writ petition is disposed of accordingly. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 21-04-2017 Prv
