THE HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO I.A.No.1 of 2019 IN/AND C.C.C.A No.69 of 2016 COMMON ORDER :

Pending C.C.C.A.No.69 of 2016 impugning the decree and judgment in O.S.No.2452 of 2011, dated 09.11.2015, of two plaintiffs against defendant of whom the 1st plaintiff died and the 2nd plaintiff came on record as per orders in I.A.No.116 of 2014, dated 16.10.2014, before the trial Court as reflected in the trial Court's decree, the said 2nd plaintiff and the defendant/appellant having present stated that they settled the matter outside the Court amicably and the terms of compromise incorporated in I.A.No.1 of 2019 filed to record the same under Order XXIII C.P.C. The terms of compromise when read over they admitted as true in seeking to dispose of the appeal in terms of the compromise. Having regard to the above, the compromise is recorded.

Accordingly, I.A.No.1 of 2019 is allowed and the appeal is disposed of in terms of the compromise. The compromise terms be appended as part of this appellate Court's decree.
