HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.791 of 2017 ORDER:

This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to direct the 2nd respondent to release 1,900 kgs of white jaggery seized in Crime No.309 of 2016. 2.

Heard and perused the material available on record. 3.

It is stated that the petitioner sold 1,900 kgs of white jaggery to the retailers under valid bills, loaded the same and engaged an auto for transportation of the same. The 2nd respondent intercepted the vehicle and seized the stock. The petitioner has not committed any offence. 4.

Considering the facts and circumstances of the case, the 2nd respondent is directed to release 1,900 kgs of white jaggery seized in the above crime to the petitioner on condition of his executing a personal bond for a sum of Rs.40,000/- (Rupees Forty Thousand only) with one surety for the like sum to the satisfaction of the 2nd respondent. However, this order does not preclude the 2nd respondent from proceeding with the confiscation proceedings initiated, if any.
