HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4745 of 2015 ORDER :
This criminal petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.294 of 2015 of Patamata Police Station, Vijayawada District, registered for the offences punishable under Sections 354(c) and 509 IPC.
2. Heard the learned counsel for the petitioner as well as the 1st respondent-State represented by the Public Prosecutor before admission and before ordering any notice to the 2nd respondent and perused the material on record.
3. A perusal of the material on record falls short for this Court to admit the application under Section 482 Cr.P.C.
4. Hence, the criminal petition is disposed of by giving liberty as the factual matrix otherwise entitles the petitioner to concession of regular bail by directing him to surrender before the learned Magistrate concerned and move for regular bail application as Section 354(C) amended Cr.P.C. part -II is non-bailable and part is bailable from nature of offence to decide and grant bail preferably on the same or atleast by next day as the petitioner is shown as student having bright academic prospects since he is a graduate in engineering and pursuing his prospective avenues for job, after hearing the A.P.P. concerned with necessary conditions.
5. Miscellaneous petitions pending, if any, shall stand dismissed ____________________________
