THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.20842 of 2009 ORDER:

The action of the respondents, in disconnecting power supply to the petitioner's electricity connection on the ground that there were arrears due to be paid for link service bearing No.H1-483 even though she had no connection with that service, is questioned in this Writ Petition as being arbitrary and illegal.

It is the petitioner's case that the link service connection is in the name of some other person; and disconnecting her power supply for the arrears due from the link service, that too without notice to her, is illegal and arbitrary. This Court, by interim order dated 24.09.2009, directed restoration of power supply to the petitioner on condition that the petitioner deposited one-fourth of the demanded amount within a period of one week.

As the complaint in this Writ Petition is of violation of principles of natural justice, suffice it if the respondents are directed not to take any coercive steps, for recovery of the arrears of electricity due, without putting the petitioner on notice; and without giving her an opportunity of being heard.

The Writ Petition is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of1. There shall be no order as to costs.
