Vijay Pavan Amaravadi v. B L Padmawathi
THE HON'BLE SRI JUSTI CE SANJAY KUMAR CI VI L REVI SI ON PETI TI ON NO.5038 OF 2018
O R D E R
The petitioner is the father of the minor child, Amaravadi Prudhvi Srihaas. He filed O.P.No.1739 of 2015 under Section 25 of the Guardians and Wards Act, 1890 before the learned XV Additional District and Sessions Judge-cum-Family Court Judge, Ranga Reddy District at Miyapur. Therein, he filed I.A.No.306 of 2016 stating that the child has a squint eye problem requiring treatment therefor and therefore, he may be permitted to take necessary steps in that regard.
His grievance in the present civil revision petition filed under Article 227 of the Constitution is that the Family Court is not passing any orders upon the pending I.A. As the medical condition of the child would require attention and it is the duty of the Family Court to act in the interest and welfare of the child in the first instance, it is not open to the Family Court to keep the I.A. pending indefinitely.
The civil revision petition is accordingly disposed of directing the learned XV Additional District and Sessions Judge-cum-Family Court Judge, Ranga Reddy District at Miyapur, to take up I.A.No.306 of 2016 in O.P.No.1739 of 2015 and dispose of the same on merits and in accordance with law expeditiously.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J 23rd NOVEMBER, 2018 Svv
