THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13730 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/A.2 to A.5 seeking anticipatory bail in connection with FIR No.1168 of 2025 of Uppal Police Station, Medchal-Malkajgiri District. The offences alleged against the petitioners are under Sections 69, 318(4) r/w.Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS'). 2.

The facts of the case are that the defacto complainant lodged a complaint on 07.10.2025 stating that she was acquainted with A.1 and his family in a Telugu Matrimony and thereafter her marriage was settled with A.1. On 08.06.2025 their engagement was performed at SVM Grand Hotel in the presence of both families. On 08.07.2025, A.1 called her to the Hotel and he sexually exploited her under the guise of marriage and thereafter he refused to marry her. As such, she requested the police for taking necessary action against A.1. Basing on the said complaint, police registered the case against the accused for the above offences.

Heard Sri V.T.Kalyan, learned counsel for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioners is that the petitioners herein are parents, grandfather and relative of A.1. Even though there are no allegations against these petitioners in the complaint filed by the complainant and even though no action is requested against these petitioners, the police arrayed them as A.2 to A.5 in this crime and trying to arrest them. As such, prayed this Court to grant anticipatory bail to the petitioners.

On the other hand, learned Additional Public prosecutor would submit that there are no allegations against these petitioners.

Considering the submissions made by both the counsel and the material on record, there are no allegations against these petitioners in the complaint and all the allegations are against A.1 only. Hence, this Court deems it fit to grant bail to the petitioners subject to the following conditions : i.

The petitioners/A.2 to A.5 shall surrender before the Station House Officer, Uppal Police Station, Medchal-Malkajgiri District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their

- 3 - executing personal bonds for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties, for the like sum each.

ii.

The petitioners/A.2 to A.5 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioners/A.2 to A.5 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
