HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30437 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the in action of respondents 3 and 4 in furnishing the information sought by the petitioner through his applications dated 13.12.2017 and 22.01.2018 under Right to Information Act, 2005, requesting them to provide the manual copies of No.3 adangals for survey Nos. 187-2, 188-1, 189-1, 1892, 189-3, 189-4, 189-5, 189-6, 189-7, 190-1, 190-2, 190-3, 190-4, 190-5, 190-6, 192-5, 192-6, 195-4, 191-4, 191-5, 191-6, 195-5, 195-6 for Fasli 1398, 1399, 1400, 1401, 1402, 1403, 1404, 1413, 1414, 1415, 1416 ie., for the years 1988, 1989, 1990, 1991, 1992, 1993, 1994, 2003, 2004, 2005 and 2006, as arbitrary and illegal.
2) The learned Government Pleader for Revenue (AP), placed on record the written instructions received, wherein it is mentioned that the information could not be furnished to the petitioner because of the pendency of the cases before the Joint Collector, Chittoor and the High Court in respect of the lands referred to above, Apart from that it is also stated that the land owners namely Smt. Kalyani and M.Damodara Naidu, filed an application before the Tahsildar, Srikalahasti, on 07.05.2018, raising objections with regard to furnishing of information without their notice.
3) Having regard to the above, the present Writ petition is disposed of, directing the respondents to pass orders on the representations dated 13.12.2017 and 22.01.2018, by giving reasons as to why they could not furnish the information, as early as possible, preferably, within a period of four to six weeks from the date of receipt of a copy of the order and communicate a copy of the same to the petitioner herein.
4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
