W.P.No.25323 of 2015 ORDER:

Heard.

The only grievance of the petitioner is that his revision petition pending before the 2nd respondent since 06-08-2015 may be heard at an early date or atleast an interim order can be considered in the stay petition. The petitioner had earlier approached this court in various writ petitions including W.P.No.23861 of 2015, which was disposed of on 31-072015, wherein the petitioner was permitted to avail remedy of revision and the impugned order therein was stayed till 10-08-2015. The petitioner now complains that though the revision was filed on 06-08-2015, neither the revision nor the stay petition is taken up for consideration. Learned Government Pleader, on instructions, submits that the 2nd respondent has already called for the records and he would fix an early date of hearing and hear and decide the revision petition.

In matters of this nature, it is appropriate for the 2nd respondent to fix the date of hearing of the revision petition and atleast consider the feasibility of passing order on the stay petition if hearing and disposal of the revision petition is not possible for various reasons within a short time. The writ petition is, therefore, disposed of directing the 2nd respondent to fix an early date of hearing and decide atleast the stay petition and pass appropriate orders within one week from the date of receipt of a copy of this order. Status-quo existing as on today to continue till the 2nd respondent passes appropriate orders, as directed. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
