THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14762 of 2014 ORDER:
This Criminal Petition is filed by the petitioner-A1 under Section Cr.P.C. seeking to quash the proceedings against him in C.C.No.570 of 2012 on the file of the II Additional Chief Metropolitan Magistrate, Vijayawada.
Heard and perused the material available on record. It is alleged that the marriage of the 2nd respondent was performed with A1. At the time of marriage, her parents offered Rs.8 lakhs towards dowry besides house site to them and all the accused demanded that her salary has to be given to them. The parents of the 2nd respondent agreed for all demands. After marriage, with the support of A2 to A4, A1 harassed her on one pretext or the other. All the accused pledged the gold ornaments of the 2nd respondent without her knowledge, and they also transferred the title of house property. On coming to know about the same, the mother and grand-parents of the 2nd respondent requested for return of the documents, gold and dowry amount. But the accused did not return the same. After arguing for some time, the learned Counsel for the petitioner confined his argument with regard to the issuance of NBWs and look out notice against the petitioner.
From the material on record, it is apparent that the petitioner is a resident of Spain. The 2nd respondent is not living in India as per the contention of the learned Counsel for the petitioner. In the above circumstances, this Court is inclined to pass the following order:
The look out notice, if any issued against the petitioner-A1, is recalled. The petitioner-A1 is directed to surrender before the Court concerned after his arrival to India and file an application to recall NBWs issued against him. On such application being filed, the Court
below is directed to recall NBWs issued against the petitioner and release him on the same day.
