HONOURABLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 6419 OF 2015 ORDER:
Heard learned Counsel for the petitioner and Government Pleader.
The Writ Petition is filed complaining inaction against the first respondent in not taking up the appeal filed against the Award in Dispute No. 175 of 2012, dated 22.11.2013 passed by the second respondent as illegal and arbitrary. Learned Counsel for the petitioner contends that on account of the first respondent's inaction in disposing of the appeal the third respondent is taking advantage of delaying the proceedings to recover the amount agreed through Award dated 22.11.2013.
Without going into the other contentions, I consider it appropriate to dispose of the Writ Petition by directing the first respondent to take up the appeal filed against the Award in Dispute No. 175 of 2012, dated 22.11.2013 for hearing and dispose of within two months from the date of receipt of a copy of this order. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs. ---------------------------- JUSTICE S.V.
