HON'BLE SRI JUSTICE S.V.BHATT W.P.No.7644 OF 2008 ORDER:
The petitioner challenges the order dated 28.02.2007 in I.A. No.627 of 2007 in O.P. No.55 of 2007 on the file of A. P. Cooperative Tribunal, Hyderabad and to quash the same, as illegal and unconstitutional.
The 5th respondent in the writ petition filed WPMP No.26806 of 2009, no doubt, for an interesting prayer to dismiss the writ petition as infructuous. The averments filed in support of the petition are that O.P. was heard and dismissed by the trial Court and the writ petition filed against the interlocutory order does not survive. Mr.Ravi Kumar, learned counsel appearing for the petitioner, submits that his client has taken away the bundle and he is not posted with latest details. This Court has reason to believe that with the dismissal of the O.P., the petitioner may not be interested in working out the relief prayed for in the writ petition and in fact does not survive for consideration.
The writ petition is dismissed as infructuous. No order as to costs.
