THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6554 OF 2017 ORDER:

Heard learned counsel for the petitioners and also the learned Public Prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent and perused the grounds in the petition.

It is the submission of the counsel for the petitioner referring to the High Court's Circular vide R.O.C.No.10/Reg.Judl/2017, dated 31.05.2017, based on the expression of the Hon'ble Apex Court in Criminal Appeal No.511 of 2017 in Aasu Vs. State of Rajasthan and batch, of the case comes within the guidelines for early disposal as pending since more than five years and it is the submission that even it is in the stage of arguments, postponing by the trial court.

Having regard to the above, this criminal petition is disposed of, directing the lower court to dispose of the case, if necessary, by fixing time for submission of any written arguments and pronounce judgment thereafter on merits, within two months from the date of receipt of copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
