HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30854 of 2018 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for Revenue (AP). With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the proceedings in R.Dis.No.A(2)/ 809/ 2016 dated 02.12.2016, passed by the fourth respondent as illegal, arbitrary and without jurisdiction. 3) There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

4) A perusal of the record would show that against the order passed by the Revenue Divisional Officer, the petitioners herein preferred a revision before the Joint Collector under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971. The said revision was filed in the month of January, 2017 and the same is pending consideration. Having regard to the pendency of the revision, questioning the order of the Revenue Divisional Officer, in the present Writ Petition cannot be entertained.

5) At this stage, the learned counsel for the petitioners submits that though the revision was filed in the month of January, 2017 till date no orders are passed either in the revision or in the I.A. filed along with the revision.

6) The Government Pleader for Revenue submits that a direction may be issued for an early disposal of the case. 7) Without going into the merits of the case and having regard to the submissions made, the present writ petition is disposed of, directing the third respondent to dispose of the revision filed by the petitioners against the order of the fourth respondent in Proceedings R.Dis.No.A(2)/ 809/ 2016, dated 02.12.2016 or pass orders in the I.A. filed along with the revision, after hearing all the concerned including the petitioners, in accordance with law, as expeditiously as possible, preferably, within a period of eight

(08) weeks from the date of receipt of a copy of the order. 8) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
