THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.11356 of 2012 ORDER:

The writ prayer is against inaction of respondents in disposing of the representation, dated 30-12-2010.

With the assistance of Sri K.S.Murthy, counsel for petitioner, this court has carefully perused the affidavit and also representation, dated 30-12-2010 said to have been filed by petitioner. As the prayer is one against inaction, this court is not proposing to consider the merits of grievance.

Suffice to note that the writ can be disposed of by this order. The petitioner is given liberty to submit copy of the representation, referred to above, together with a copy of this order to 3rd respondent, within four weeks from the date of receipt of a copy of this order. 3rd respondent is directed to consider the representation in accordance with the extant orders/Board Standing Orders and verify the entitlement of petitioner and pass appropriate orders. It is made clear that this court is not considering the merits and it is for 3rd respondent to independently consider and take a decision in this behalf on relevant factors as to whether the land is available for assignment and if so, whether the petitioner is entitled for grant of assignment or not and pass appropriate orders expeditiously. Accordingly, the writ petition is disposed of. No order as to costs.
