THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.9054 of 2018 ORDER:
This petition is filed under Section 482 of Criminal Procedure Code to quash the proceedings in C.C.No.55 of 2016 pending on the file of Judicial Magistrate of First Class, Guntkal, registered for the offence punishable under Section 498-A read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act, against petitioner. The petitioner though raised several contentions in the petition about the mental abnormality of the de facto complainant, they are not required to be gone into at this stage. The main grievance is that he is working as Customer Relation Manager in Indian Bank, Tirupathi Branch and he is roaming around the Court for the last two years and experiencing lot of inconvenience to attend the Court and requested to pass appropriate order.
Learned counsel for the petitioner requested the Court to dispense with the appearance of the petitioner. In view of the difficulty in attending the Court, it is appropriate to direct the Magistrate to dispose of C.C.No.55 of 2016, pending on its file as expeditiously as possible in any event not later than six months from the date of receipt of copy of this order. Request of learned counsel for the petitioner to dispense with the appearance of the petitioner cannot be considered while exercising power under Section 482 Cr.P.C. However, it is left open to the petitioner to file appropriate application under Rule 37 of the Criminal Rules of Practice and on filing such application, the
Magistrate is directed to dispose of the said application within a week from the date of application.
With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
