HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.30415 of 2018 Order: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) The petitioner proposes to expand its existing unit, which requires Environmental Clearance. The complaint is that the public hearing on expansion is not finalized. The plea appears to be that the scheduled public hearing was adjourned on account of the unfortunate demise of the former Prime Minister of India. 2.

Learned counsel for the petitioner submits that the delay in holding public hearing would be prejudicial to the interest in expanding its unit.

Learned Standing Counsel for the 2nd respondent-Pollution Control Board submits that the public hearing is now scheduled to be held on 29.9.2018.

Learned counsel for the petitioner submits that the rescheduled public hearing is fixed on 29.9.2018. 5.

In view of the above, taking the submissions of the learned Standing Counsel for the 2nd respondent into consideration, it is directed that the re-scheduled public hearing on proposed expansion shall be held as scheduled, unless there is some exceptionally exceptional event, which makes it necessary to further adjourn the matter.

The Writ Petition is ordered accordingly.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
