G. Jagadish, v. The Additional Agent To The Government, (P.O.I.T.D.A.)
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION NO. 22408 of 2017 ORDER :
Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in seeking to evict the petitioner from his building situated in H.No.5-31/ A of Krishnaveni College situated at Lakshmidevipalli Village of Lakshmidevipalli Mandal of Bhadradri, Kothagudem District in pursuance of the orders passed by respondent No.2 in LTR Case No.60/ 2016/ KGM, dated 27.04.2017, pending disposal of appeal filed before respondent No.1 on 31.05.2017, as illegal and arbitrary. 3.
Though various grounds are raised, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the appeal filed by the petitioner against the LTR Case No.60/ 2016/ KGM, dated 27.04.2017, at the earliest. He also places on record the similar orders passed by this Court in W.P.No.8079 of 2017, wherein this Court granted interim stay of all further proceedings in LTR case filed therein.
4.
Having regard to the above, without going into merits of the case, the writ petition is disposed of directing respondent No.1 to dispose of either the appeal filed by the petitioner or the stay application filed by the petitioner, if the same is in order, within a
period of six weeks from the date of receipt of a copy of the order. Till such time, status quo as on today shall be maintained. No costs. Consequently, miscellaneous petitions, if any pending, shall stand closed.
