THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.23406 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in acquiring the Petitioners lands in Sy.No.192, to an extent of Ac.5.5 Gts, situated at Velerupadu Revenue Village and Mandal, West Godavari District and the dwelling house bearing No.5-77 (New 4-79 with Assessment No.693 (Part)) along with its appurtenant site of an extent of 1067 sq.yds situated in Sy.No.143/B, house bearing No.5-78 (New 3-178 with Assessment No.695 (Part)) along with its appurtenant site of an extent of 1287 sq.yds situated in Sy.No.143/B and house bearing No.5-79 (New 4-82 with Assessment No.696 (Part)) along with its appurtenant site of an extent of 1567 sq.yds situated in Sy.No.

143/B, of Velerupadu village, Gram Panchayat and Mandal and paying the compensation to the Respondents 6 to 10 without considering Petitioners herein and without paying the compensation to the Petitioners and trying to pay the compensation amounts in favour of the Respondent Nos. 6 to 10 in respect of the land in question as illegal and void and opposed to Articles 14, 19, 21 and 300-A of Constitution of India and consequently to direct the respondents 1 to 5 by considering the representation dated 14.06.2017 to pay the compensation to the Petitioners by acquiring the Petitioners lands by issuing land acquisition proceedings in the interest of justice."

Heard learned counsel for the petitioners and also the learned Government Pleader for Land Acquisition for official respondents 1 to 5, before ordering notice to the unofficial respondents 6 to 10 and perused the prayer in the writ petition with supporting affidavit and also the written instructions received by the learned Government Pleader. 3.

As per the written instructions, there is no notification under Section 11 of the Act 30 of 2013 for acquisition so far. By recording the said submission, this writ petition is disposed of, by giving liberty to the petitioner, whenever the acquisition proceedings are initiated, to make an appropriate representation for consideration pursuant to the provisions of the Act.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
