This Court made the following :

THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16315 of 2015 ORDER :

The petitioner's daughters are the co-owners of premises bearing D.No.3-1104, near Lalitha Theatre, Amalapuram. The petitioner alleges that the co-owner of the building started constructing 3rd floor which is a common facility to both the owners and no exclusive rights were vested in the 3rd respondent. Having noticed that the 3rd respondent has raised pillars to construct 3rd floor illegally without obtaining building permission and without the consent of the daughters of the petitioner, the petitioner complained to the Municipal authorities. But no action was

taken by the Municipal authorities. Whereas the 3rd respondent is undertaking construction of pillars.

2. When the matter is taken up for consideration learned Standing counsel representing the 2nd respondent, on instructions, submits that on 03.03.2015 show cause notice was issued against illegal construction. As the 3rd respondent did not respond to the notice issued and no explanation was filed, on 16.03.2015 confirmation notice was issued and as of now, no further construction is taking place and that the Municipality is monitoring the activities of the 3rd respondent. The Municipality is contemplating to take further action as warranted by law as a consequence to issuance of confirmation notice on 16.03.2015.

3. In view of the said submission of the learned Standing counsel since appropriate steps are taken by the Municipal authorities as warranted by law, this writ petition is closed as no further orders are required. There shall be no order as to costs.
