HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.29186 of 2015 Date:16.09.2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This Habeas Corpus petition is filed seeking production of five persons/detenus, namely; 1) Syed Deenavali, 2) Syed Abdul Khadar, 3) Syed Habeeba, 4) Sk. Khaja Mohiddin and 5) Syed Sabeera. Learned Government Pleader has filed counter affidavit and has stated therein, that Syed Deenavali and Syed Abdul Khadar are shown as accused in Crime No. 168 of 2015. Syed Abdul Khadar is absconding; whereas Syed Deenavali came to be arrested on 8.9.2015 and presently he is in judicial custody. In so far as remaining three persons are concerned, it is stated that they are not wanted in any case and the police have never arrested them.
According to respondent No. 6, Sk. Khaja Mohiddin and Syed Sabeera are husband and wife. Sk. Khaja Mohiddin is the son-in-law of the petitioner and Syed Sabeera is her daughter. Sk. Khaja Mohiddin is a Constable. He and his wife, Syed Sabeera, have given statement to the police stating that they are not illegally detained by anybody.
In view of the statements made on affidavit by the 6th respondent, we do not find any substance in the writ petition. Hence, the writ petition is dismissed.
