CVNR,J & TA,J WP.30965 of 2018 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON No.30965 of 2018 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus, directing the respondents to produce the husband of the petitioner, by name, M.Santosh Kumar, S/o.M.Purna Singh (for short "the alleged detenu") before the Court and set him at liberty. In her affidavit, the petitioner alleges that on 11.06.2018 two constables of the 3rd respondent Police Station along with the sisters of the alleged detenu came to her house and took away the alleged detenu, and that left with no other alternative, she filed this writ petition.
The alleged detenu is personally present in the court. He has stated that unable to bear the harassment meted by the petitioner, her parents and other relatives, he has ran away to Khanduva in Madhya Pradesh on 28.05.2018 on his volition, and that the police are no way concerned with his leaving the matrimonial home. He further submitted that he is facing life threat from the petitioner and from her parents' side, and that he would like to live separately from the petitioner.
In the light of the views expressed by the alleged detenu, as above, we are convinced that the alleged detenu has never been in the police custody.
CVNR,J & TA,J WP.30965 of 2018 For the aforementioned reasons, we do not find any merit in the writ petition, and the same is accordingly dismissed. No order as to costs.
