CVNR,J & GSP,J W.P.No.16765 of 2012 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed by the Northern Power Distribution Company Limited, Karimnagar, challenging the orders passed by the District Consumer Disputes Redressal Forum, Karimnagar and the Andhra Pradesh State Consumer Disputes Redressal Commission, Hyderabad, in Consumer Complaint (C.C.) No.72 of 2008 and F.A.No.637 of 2009, respectively.

The writ petition is liable to be dismissed for more than one reason. In the first place, neither of the two fora whose orders are questioned is impleaded in this writ petition. Further, the Divisional Engineer of the petitioner was opposite party No.2 in C.C.No.72 of 2008 and respondent No.2 in F.A.No.637 of 2009. He remained ex parte before both the fora. No explanation, whatsoever, has been offered by the petitioner for remaining ex parte and allowing an order adverse to its interests passed. The jurisdiction under Article 226 of the Constitution of India being purely discretionary, this Court would not come to the aid of an authority, which was highly negligent in protecting its interests before two quasi judicial fora. For both the above reasons, we are not inclined to entertain this writ petition for adjudication on merits.

Hence, the Writ Petition is dismissed.

As a sequel to dismissal of the writ petition, W.P.M.P.No.21525 of 2012 filed by the petitioner for interim relief stands dismissed as infructuous.
