THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4567 OF 2017 ORDER :
Petitioner was appointed as driver in the respondentCorporation. While he was working as driver, he was subjected to medical examination. Petitioner was examined by the Medical Board. Initially he was declared as unfit as driver. The Medical Board also declared him as unfit to drive. However, the Medical Board declared the petitioner as fit for alternative employment as Shramik. Accordingly, petitioner was provided alternative employment by order dated 19.10.2016. Petitioner accepted the said job and is working. According to petitioner he has recouped from the earlier ailment and is fit to perform the duties as driver. This writ petition is filed praying that petitioner be subjected to medical examination to assess his suitability to perform the duties for the post of driver.

When the matter is taken up, learned standing counsel while contending that there is no such provision for referring to medical examination after he was declared as unfit and providing alternative employment, he also submits that no request is made by the petitioner for such reference and straight away this writ petition is filed.

Having regard to the said objection learned counsel for the petitioner submits that liberty be granted to the petitioner to make a representation to the Depot Manager, Midhani Depot, Ranga Reddy District and the same may be considered within a time frame.

Having regard to these submissions, without expressing any opinion on merits, the Writ Petition is disposed of granting liberty to the petitioner to make representation to the Depot Manager, TSRTC, Midhani Depot, Ranga Reddy District-3rd respondent requesting to consider for reference to Medical Board and if such a request is made, the 3rd respondent shall consider and pass appropriate orders as warranted by law, within a period of four (4) weeks from the date of receipt of such representation. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
