The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, challenging the action of the 4th respondent in not registering the crime on the complaints made by the petitioner. 2.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the daughter-in-law of the petitioner died accidentally and on that, the 5th respondent, who is none other than the father of the daughter-in-law of the petitioner, lodged a complaint against the petitioner, his son and wife. While so, on 15/16.3.2016, the 5th respondent along with 14 others formed into an unlawful assembly, entered into the house of the petitioner and destroyed the furniture. In spite of complaints made by the petitioner, no case was registered against the 5th respondent and others.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the official respondents are directed to register FIR on the complaint made by the petitioner, if the complaint discloses any cognizable offence. If the official respondents fail to register FIR, the petitioner is at liberty to avail the remedies that are available under Criminal Procedure Code. 5.
