Petitioner is working as a Conductor. On 28.02.2017, he was put off duty and was also served with the charge sheet. The sum and substance of the allegation is that the petitioner collected an amount of Rs.16/- from two passengers but found that he issued same ticket bearing number as mentioned in a white paper to a passenger which was already issued to another passenger. 2.

Petitioner filed representation on 23.02.2017 addressed to the Depot Manager, APSRTC, Kovvur Depot, West Godavari District, the 3rd respondent, explaining the circumstances in which the alleged issuance of double ticket was made. He explained that he was sick and unwell on that day and could not properly verify the number and it was not intentional.

When the matter is taken up for consideration, learned counsel for the petitioner submitted that since his grievance is ventilated in his representation, dated 23.02.2017, which is yet to be acted upon, the petitioner would be satisfied if a direction is issued to pass orders on the said representation within a fixed time frame.

However, as the order was passed by the Depot Manager, the question of consideration by him does not arise. Having regard to the submission of learned counsel for petitioner, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the 3rd respondent to forward the

representation submitted by the petitioner to the Regional Manager, A.P.S.R.T.C., West Godavari Region, Eluru, West Godavari District, the 2nd respondent, within one week from today and on receipt of such representation, the 2nd respondent shall consider and pass appropriate orders as warranted by law by assigning due reasons in support of his decision, within a period of two weeks thereafter and communicate the same to the petitioner. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
