THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30528 of 2018 ORDER:

show cause notice bearing No.3950/TPS/C3/GHMC/2018, dated ___/07/2018, issued by the respondent-Municipal Corporation under the provisions of Section 450 of the G.H.M.C.Act, 1955, is under challenge in the present Writ Petition.

By way of the said show cause notice, the respondentMunicipal Corporation directed the petitioner herein to show cause within seven days as to why the building permission accorded vide permit No.3/C3/09365/2017, dated 05.10.2017, in file No.3/C3/03950/2017, should not be cancelled.

According to the petitioners, in response to the said show cause notice, they submitted an explanation on 06.08.2018 to the respondent-Municipal Corporation (received on 07.08.2018) and the said explanation is still pending consideration before the respondent-authorities.

Since the impugned notice is only a show cause notice and as the petitioners herein already submitted an explanation in response to the said show cause notice, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the respondent-Municipal Corporation to consider the explanation, dated 06.08.2018 (received on 07.08.2018), and take further action/pass appropriate orders. It is also made clear that pending consideration of the said explanation and passing of final orders, there shall be no coercive action in respect of the subject structures.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
