W.P.No.25438 of 2015 ORDER:

Heard.

The grievance of the petitioner is that the 4th respondent is not receiving and considering his application for mutation with regard to the land admeasuring Ac.4-00 gts., in Sy.No.1/21 situated at Lakshmi Deva Palli Village, Palvancha Mandal, Khammam District. The petitioner states that the said land belongs to his father, who expired 20 years back, and thereafter, he succeeded to the said land. The petitioner, however, did not approach the 4th respondent seeking mutation allegedly on the ground that he was under the impression that the said land would automatically devolve upon him. Even if the petitioner seeks to make an application belatedly, there is no reason why the 4th respondent is refusing to accept the same. Further, it is open for the petitioner to send the same through registered post with acknowledgement due.

However, the petitioner has to make application in the prescribed proforma under A.P.Rights in Land and Pattadar Pass Books Act, 1971 read with A.P.Rights in Land and Pattadar Pass Books Rules, 1989. If any such application is received, the 4th respondent shall consider the same in accordance with law and pass appropriate orders expeditiously. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
