This petition is filed under Section 482 Cr.P.C., to recall NBW issued against the petitioner/accused vide docket order dated 16.03.2015 in C.A.No.175 of 2011 in CC No.600 of 2008 passed by the III Additional Sessions Judge, Nellore.

2. Learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw criminal petition with a liberty to file a petition before the trial court under Section 70(2) Cr.P.C. to recall NBW issued against him. Permission is granted.

3. Accordingly, this criminal petition is dismissed as withdrawn granting liberty as prayed for. The trial court is hereby directed to dispose of the application, if any, filed by the petitioner under Section 70(2) Cr.P.C., on the same day, in accordance with law.
