HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.15080 of 2013 ORDER:

This writ petition is filed seeking the following relief : "..to issue a writ, order, or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent not to demolish the small houses of the petitioners over an extent of 85 square yards in each Plot admeasuring 133 sq.

yards each in Plot Nos. 55, 54, 24, 2, 56, and 17 each respectively in Sy.Nos. 707/2, 707/3, 708/2, 708/3 situated at Garmilla village, Mancherial Mandal, Adilabad district without issuing any notice and opportunity as being illegal, arbitrary, unreasonable and in violation of principles of natural justice and issue a consequential direction to the respondent not to demolish the petitioners'

houses without following due process of law." When the matter came up for admission, the following interim direction was passed on 22.05.2013 :

" There shall be interim direction to the respondent not to demolish the houses of the petitioners except in accordance with law."

When the matter came up for hearing, learned counsel for the petitioners and learned Standing Counsel for the respondent submit that the writ petition can be disposed of directing the respondent to follow the procedure in accordance with law, if the respondent intends to demolish the subject houses. In view of the above submission, the writ petition is disposed of directing the respondent to follow due procedure in accordance with law, before demolition of the premises of the petitioners. No order as to costs.
