M/S Durgeswari Enterprises Rep By G. Manisha W/O G.Narsingh v. State Of Telengana Rep By Secretary Municipal
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16806 of 2017 ORDER:
1.
This writ petition is filed challenging the inaction of the 2nd respondent in considering the representation made by the petitioner for extension of the period of contracts for two more years. 2.
It is submitted that the petitioner entered into two contracts with the 2nd respondent on 16.8.2016 for collection of fee on parking of vehicles in the premises of Jiyaguda slaughter house in Circle No.7B, CZ, GHMC and for collection of fee on sale of live sheep and goats in the said premises, for a period of 12 months. The petitioner incurred heavy loss due to demonetization and therefore, a representation was made to the 2nd respondent to extend the period of the above two contracts for two more years. But the 2nd respondent has not considered the representation of the petitioner so far. Hence, the petitioner filed this writ petition. 3.
The learned Government Pleader appearing for the respondents submitted that there is no provision for extension of the period of the contracts, and after completion of the contract period, the party should participate in the tender process, and the contract will be given to the highest bidder.
4.
From the material available on record, it is obvious that the representation made by petitioner for extension of period of contracts is pending consideration. Since the petitioner sought for extension of period of contracts on the ground that it has incurred heavy loss due to demonetization, it is left open to the 2nd respondent to consider the
representation of the petitioner and pass appropriate orders in accordance with law on or before 30th June, 2017.
5.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. _________________ Justice Raja Elango Dated: 1.6.2017.
