Venkataramana, learned Counsel for the petitioner.

Learned Counsel for the petitioner submits that basing upon the submission made by the learned Counsel for the petitioner in W.P. No.26941 of 2009, this Court dismissed the said Writ Petition as infructuous on 06.03.2024. However, the Registry prepared the order in W.P. No.26491 of 2009.

Learned Counsel further submits that the cause in the present Writ Petition does not survive unless the said order is recalled and the Writ Petition is taken on record, the petitioner will be put to great hardship.

Learned Assistant Government Pleader for Assignment is not opposed the same.

Taking into consideration of the submissions made by the learned Counsel for the petitioner and also the averments made in support of the application, I.A. No.1 of 2025 is ordered.

Order dated 06.03.2024 is recalled. The Writ Petition No.26491 of 2009 is restored and

the Registry is directed to post the Writ Petition before the concerned Court.
