Heard Sri G.Ravi Mohan, learned counsel for the petitioner as well as the learned Special Public Prosecutor for ACB.

The present Criminal Petition is filed seeking the Court to relax the condition that is imposed upon the petitioner while granting bail by the Court of Special Judge for Trial of SPE & ACB cases, Hyderabad, in Crl.M.P.No.541 of 2022 in Crime No.8/RCT-CR-1/2022, dated 27.07.2022.

The condition sought for relaxation is with regard to the attendance of the petitioner before the Office of DSP/ACB concerned on every Sunday and Thursday in between 10.00AM and 5.00PM until further orders. Learned counsel for the petitioner states that the petitioner is complying with the condition since the date of his release i.e. from the month of July 2022 and therefore, the condition imposed may be relaxed.

On the other hand, the submission of the learned Special Public Prosecutor is that the petitioner may at least be directed to appear once in a month. The requirement for such attendance is not stated. Also, by the material available on record, what could be perceived is that the case was registered in the month of June 2022 and the petitioner is attending twice a week since July 2022. Thus, the petitioner is attending before the concerned since four months. No material is on record to show that the petitioner had at any time during the interregnum period has influenced the witnesses or interfered with the investigation process. Therefore, this Court is of the view that the attendance, as prayed for, can be dispensed with. 5.
