THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2529 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioner, challenging the order, dated 21.07.2015 passed in Crl.M.P. No.91 of 2014 in O.P. No.921 of 2014 by the Additional Family Judge, Visakhapatnam, whereby the learned Judge directed the petitioner to pay the interim maintenance ordered on 30.07.2014, while ordering notice to the 2nd respondent in that O.P.

The petitioner is the husband of the 2nd respondent. She filed the above OP under Section 125 Cr.P.C., before the Court below against the petitioner seeking maintenance. She filed Crl.M.P. No.91 of 2014 seeking interim maintenance at Rs.25,000/- per month, pending disposal of the main case. The Court below partly allowed the said application granting interim maintenance at Rs.6,000/- to the 2nd respondent. Aggrieved by the same, the present revision is filed. Heard and perused the material available on record. Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Criminal Revision Case is disposed of modifying the order under revision, as follows: The petitioner is directed to pay interim maintenance at the rate of Rs.

3,000/- per month to the 2nd respondent from the date of the above application till disposal of O.P. He is also directed to pay the said maintenance amount on or before 10th of every succeeding month and the arrears if any, within three months from the date of receipt of a copy of this order. The trial Court is directed to dispose of the O.P.

revision.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J October 30, 2015 KTL
