THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12743 OF 2023 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.10 in Crime No.221 of 2022 on the file of EOW Team Police Station, CCS, DD, Hyderabad, registered for the offences under Sections 406 and 420 r/w. 34 of IPC and Section 5 of TSPDFE Act. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that this petitioner was involved in collecting the amounts from various persons on behalf of A-6 company i.e., M/s.Magnus Corporation.

Learned counsel appearing for the petitioner would submit that other accused were given notice under Section 41-A Cr.P.C, however, the petitioner was arrested.

Since the petitioner is in jail and other accused were issued notice under Section 41-A Cr.P.C., the petitioner can be granted the relief of regular bail, subject to following conditions:-

i) The petitioner/Accused No.10 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to the satisfaction of the XII Additional Chief Metropolitan Magistrate at Hyderabad.

ii) The petitioner/Accused No.10 after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period four weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused No.10 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
