THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24247 of 2015 ORDER:

The petitioner was appointed as fair price shop dealer of Shop No.28 of Sandepudi Village, Edlapadu, Guntur District. While so, on 09.05.2015, the Assistant Supply Officer, Narsaraopet, inspected the shop and noticed some irregularities. Based on the report submitted by the Assistant Supply Officer, the third respondent suspended the authorization of the petitioner by order dated 10.06.2015. Against the said order of suspension, the petitioner preferred an appeal to the second respondent along with a stay application. When the appeal was not disposed of by the second respondent, the present Writ Petition is filed.

The facts stated by the petitioner indicate that the authorization of the petitioner was suspended on 10.06.2015 on the basis of four irregularities noticed against the petitioner. The petitioner submitted explanation on 18.06.2015. When the appeal is preferred against the order of suspension, the second respondent did not pass any orders.

In the circumstances, this Court feels that instead of driving the petitioner to pursue the appeal before the second respondent, the interest of justice would be met if the third respondent is directed to take up the enquiry and complete the same in view of the explanation submitted by the petitioner, within a period of thirty days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 04.08.2015 vs
