THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.13469 of 2011 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed asking for a writ of Mandamus commanding the District Collector, Ranga Reddy District, to protect the Government lands in Nizampet, Dommara Pochampally, Gajula Ramaram, Suraram, Qutubullapur, Doolapally, Mallampet, Gagillapur, Dundigal, Bachupally and Pragatinagar Villages of Qutubullapur Mandal, Ranga Reddy District and also to undertake the exercise of eviction of encroachers.
Counter affidavit has been filed and in fact in the counter affidavit, it is admitted that there had been encroachments and action has been taken. Such statement has been made in paragraph-5 of the counter affidavit giving the details of the encroachers and the action taken.
Affidavit in reply has been filed and in the affidavit in reply, it has been stated that some more plots of lands are traced out. In paragraph-3 onwards of the affidavit in reply detailed particulars of such plots of lands are given.
We therefore direct the District Collector to take note of the information furnished in paragraph-3 onwards of the affidavit in reply and to take steps in accordance with law for eviction of the unauthorized encroachments done either by making constructions or
otherwise. This entire eviction drive shall be completed in accordance with law within a period of six months from the date of receipt of a copy of this order.
