THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO. 33230 OF 2013 ORDER:

Heard the learned counsel for the petitioner and the learned GP for respondent Nos. 1 and 2.

The prayer sought in the Writ Petition is as under: "to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 2nd respondent in pressurizing the petitioner to withdraw the suit and to compromise with the 3rd respondent in respect of land situated in Sy. No 327/3A3 admeasuring Ac. 0.48 cents situated in Panchalingala village, Kurnool mandal and district as illegal, arbitrary and one without jurisdiction and in violation of Article 14 and 300(A) of the Constitution of India and consequently direct the respondents not to interfere with the civil disputes."

The basic allegation made against respondent No.2 is that he is pressurizing the petitioner to withdraw the suit and compromise with respondent No.3 in respect of land in Sy.No.327/3A3 admeasuring Ac.0.48 cents situated in Panchalingala village, Kurnool mandal and district. 4.

Learned GP placed on record, the written instructions received from the Inspector of Police, Kurnool Taluka Urban P.S., Kurnool district.

A perusal of the said instructions would reveal that respondent No.3 has lodged a private complaint before the learned Additional JFCM Court, Kurnool against the petitioner and others with regard to the above said land. Pursuant to the said complaint, a crime has been registered vide FIR.No.230 of 2013 for the offence under Section 423 read with 34 IPC and the matter is under investigation. It is further mentioned that except registering the above said crime against the petitioner and others, the respondent Police neither harassed nor threatened and interfered with the life, liberty and property of the petitioner.

6. Taking into consideration the above said statement, this Court is of the opinion that no further orders are required in this Writ Petition.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
