THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.2183 of 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code') requesting to quash the First Information Report in Crime No.930 of 2016 of Uppal Police Station, Rachakonda, Ranga Reddy District.

The petitioner, who is arraigned as accused No.1, alleged to have committed the offences punishable under Sections 420 and 406 IPC.

Sri N.Mukund Reddy, learned counsel for the petitioner, would submit that the complaint does not disclose any allegations touching the complicity of the petitioner in the commission of offences alleged and, in fact, the petitioner is totally unaware of the contents therein and she has not collected any amounts as alleged and, thus, pleads her innocence and false implication.

The complaint clearly reflects the name of the petitioner along with one Apuroopa and their collecting the amounts and not crediting the same into the account of their Company, which came to light only when one customer, Rajesh along with others came to the showroom and created nuisance. The complaint also shows that the de facto complaint paid Rs.1,50,000/- to the said Rajesh. All these constitute prima facie allegations to proceed with the investigation.

Accordingly, the Criminal Petition is dismissed at the stage of admission itself.

Miscellaneous applications, if any, pending in the present petition stand closed.
