THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.8306 of 2011 ORDER:

Heard learned counsel for petitioners and the Assistant Government Pleader for Home.

The petitioners pray for Mandamus declaring the action of 1st respondent in forwarding ROR (original) of Mittanandimalla and Nagalkadmur Villages of Narva Mandal, Mahabubnagar District, instead of forwarding relevant record of ROR for investigation in C.C.No.189 of 2009 on the file of the Judicial First Class Magistrate, Atmakur(A) as illegal, arbitrary and unconstitutional.

The Assistant Government Pleader, basing on the instructions dated 31-03-2011, submits that the respondents are investigating charges of forgery and fabrication of revenue records and therefore, for proper and effective investigation, the originals are required. The originals have been filed along with charge-sheet. After disposal of C.C.No.189 of 2009, the original ROR will be returned to the revenue Department.

The statement is placed on record.

The writ petition is disposed of accordingly. C.C.No.189 of 2009 is already heard and decided. It is needless to observe that as undertaken by the respondents, the original record is collected from the Court and returned to Revenue Department. No order as to costs.
